These Terms of Service ("Terms") govern your access to and use of the sundown.id website and the SunDown mobile app (together, the "Service"), operated by SunDown ("SunDown," "we," "us," or "our") in Bali, Indonesia. By creating an account, browsing venues, or making a booking through the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
SunDown is a discovery and booking platform that connects guests with independently owned and operated beach clubs, bars, restaurants and other nightlife venues in Bali ("Venue Partners"). SunDown is a technology intermediary: we do not own, operate, or manage any Venue Partner, and we are not responsible for the venue's premises, staff, service quality, pricing changes, alcohol service, or any incident that occurs on-site. Your experience at a venue is governed by that venue's own policies and applicable law.
You must be at least 18 years old to create an account or make a booking through SunDown. Many Venue Partners serve alcohol and may enforce their own (potentially higher) minimum age or ID requirements for entry — SunDown is not responsible for a venue refusing entry for age or dress-code reasons. By using the Service, you represent that you meet these requirements.
You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at partnerships@sundown.id if you suspect unauthorised use. You agree to provide accurate, current information when creating your account and keep it up to date.
When you book a table through SunDown:
Payments made through the Service are processed by a licensed third-party payment gateway. SunDown does not store your full card or bank account details. Prices, deposits, and minimum spends are set by the Venue Partner and may be subject to service charges, taxes, or currency conversion fees outside SunDown's control. Refunds, where applicable, are subject to the relevant Venue Partner's cancellation policy.

Venue Partners who list on SunDown enter into a separate partner agreement with us covering their listing, any commission or fee arrangement, and their obligations to guests. Nothing in these Terms creates an employment, agency, joint venture, or partnership relationship between SunDown and any Venue Partner beyond that separate agreement.
The Service, including its design, text, graphics, logos, and the Sandy AI concierge, is owned by SunDown or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent. Venue Partner content (photos, descriptions) remains the property of the respective venue or its licensors.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including — to the extent permitted by law — warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that venue information (hours, pricing, availability) is always fully up to date. AI-generated recommendations and responses from Sandy are provided for convenience and may occasionally be inaccurate — always confirm important details (pricing, availability, dietary/allergy information) directly with the venue.
To the maximum extent permitted by applicable law, SunDown and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service or your visit to any Venue Partner. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid to SunDown (not the venue) in the twelve months preceding the claim, where applicable law permits such a limitation.
You agree to indemnify and hold SunDown harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Service, or violation of any third-party right, including a Venue Partner's rights.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to SunDown, other users, or Venue Partners. You may stop using the Service and delete your account at any time by contacting us.
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Bali, Indonesia, unless otherwise required by applicable consumer protection law in your jurisdiction.
We may revise these Terms from time to time. We'll update the "Last updated" date above, and for material changes, we'll provide notice through the app, website, or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
